The rules of the road for using qmortgage.ai. Effective May 2, 2026.
These Terms of Service (“Terms”) govern your use of the website at qmortgage.ai and any related subdomains operated by Q Mortgage LLC (“Q Mortgage,” “we,” “us,” or “our”). They cover the marketing website only — once you start a formal mortgage application, that file is governed by the consents and disclosures inside our secure application portal, not by these Terms.
1. Acceptance of these Terms
By visiting, browsing, or submitting information through this website, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please stop using the site.
2. What this site is (and isn’t)
Q Mortgage is a Texas-licensed mortgage broker (NMLS #2567464). This website is an informational marketing tool that describes the loan programs we offer, provides estimating calculators, and lets you contact a loan officer. It is not the place where formal mortgage applications happen.
- Contact and pre-qualification submissions are inquiries. When you submit a contact form, request a callback, or complete the pre-qualification flow, you are starting a conversation with a loan officer — not submitting a mortgage application under federal law.
- Formal applications happen through our secure application portal. That portal is where credit pulls, signed disclosures, income documentation, and the Uniform Residential Loan Application (Form 1003) are collected. Different rules and consents apply there.
3. Not legal, tax, or financial advice
Everything on this site — loan-program pages, blog posts, calculators, valuations, guides — is general information about mortgage products, not personalized legal, tax, accounting, or financial advice. Mortgage rules vary by state, lender, program, and borrower scenario. Before you make a decision that affects your taxes, your credit, your title to real property, or your legal rights, talk to a licensed attorney, a CPA or enrolled agent, and a Q Mortgage loan officer who has reviewed your full file.
4. Calculator disclaimers
Our affordability, payment, refinance, DSCR, and similar calculators are estimating tools only. They use the inputs you provide and a small number of assumptions to produce a rough number. Real loan pricing depends on dozens of variables we cannot see from a calculator: full credit profile, debt-to-income ratio, reserves, occupancy, loan-to-value, property type, lock period, current daily pricing from the wholesale lender, and program overlays. Any number you see in a calculator is an estimate — not a quote, not a commitment, not a guarantee. Your actual rate, payment, and terms will be set by full underwriting at the time of formal application.
5. Home Valuation Tool disclaimer
The Home Valuation Tool returns an Automated Valuation Model (AVM) estimate sourced from a third-party data provider. The AVM is generated by a statistical model that relies on public records, recent sales, and limited property characteristics. It is not an appraisal, was not prepared by a state-licensed or state-certified appraiser, and does not comply with the Uniform Standards of Professional Appraisal Practice. It cannot be used as the basis for a credit decision, a loan-to-value calculation in underwriting, or any other purpose that federal Regulation Z (12 CFR Part 1026) reserves for an appraisal or other written valuation. If you need an appraisal, your loan officer will order one through an independent Appraisal Management Company during the formal application process.
6. Rates and pricing
Any sample rates, APRs, payment examples, or pricing scenarios published on this site are for illustration only. Rates change throughout each business day and vary by program, lock period, credit score, loan-to-value, occupancy, and borrower profile. Nothing on this site constitutes a rate lock or a commitment to lend. A binding rate is established only when you formally lock with a wholesale lender during the loan process.
7. Links to third-party sites
We link to third-party resources to help you — our secure loan application portal, NMLS Consumer Access, the Texas Department of Savings and Mortgage Lending, the Consumer Financial Protection Bureau, our social-media profiles, and select industry partners. Q Mortgage does not control those sites and is not responsible for their content, security, privacy practices, or the accuracy of the information they publish. Visiting them is at your own risk and subject to their own terms.
8. Intellectual property
The content on this website — copy, page layouts, graphics, photography we commissioned, the Q Mortgage logo and word mark, the design system, and the underlying source code — is owned by Q Mortgage LLC or licensed to us, and is protected by United States copyright and trademark law. You may view and print pages for your personal, non-commercial use. You may not republish, scrape, mirror, or build a competing site from our content without our written permission.
Loan-program names and the marks of their administering agencies — FHA, VA, USDA, Fannie Mae, Freddie Mac, Ginnie Mae, the Equal Housing Lender mark, and any other government or industry trademarks shown on this site — belong to those entities. We use them only to describe the programs we originate.
9. Acceptable use
When you use this site you agree that you will not:
- Submit false, misleading, or impersonated information through any form.
- Scrape, crawl, or systematically harvest content, including via automated tools, headless browsers, or AI agents acting without our permission.
- Reverse engineer, decompile, or attempt to extract the source code of any client-side application or calculator beyond what is publicly served.
- Probe for vulnerabilities, run denial-of-service attacks, or otherwise interfere with the operation of the site or our service providers.
- Use the site to violate fair-housing, fair-lending, or anti-discrimination law, or to facilitate fraud against any borrower, lender, or investor.
10. Submitted information
Information you submit through forms on this site is handled per our Privacy Policy. You confirm that the information you provide is yours to share, that it is accurate to the best of your knowledge, and that you are at least 18 years old and legally able to enter into a mortgage.
11. No warranty
We work hard to keep this site accurate and available, but it is provided as is and as available. Q Mortgage disclaims all warranties to the maximum extent allowed by Texas law, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. Loan programs, rates, fees, eligibility rules, and disclosures change frequently — the authoritative numbers for your file come from your loan officer at the time of application, not from this site.
12. Limitation of liability
To the maximum extent permitted by law, Q Mortgage LLC and its members, officers, employees, and contractors will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages — including lost profits, lost savings, or lost opportunity — arising from your use of this site or reliance on its content. Our total aggregate liability for any direct damages arising from your use of this site is limited to one hundred U.S. dollars (US $100). This section does not limit liability for fraud, willful misconduct, or anything else that cannot be limited under applicable law.
13. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The exclusive venue for any dispute that cannot be informally resolved is the state or federal courts located in Collin County, Texas, and you consent to the personal jurisdiction of those courts.
14. Changes to these Terms
We may update these Terms from time to time as our products, vendors, or the law change. When we do, we will update the effective date at the top of this page. Material changes will also be flagged through the cookie banner on your next visit so returning visitors are prompted to review. Continued use of the site after the effective date constitutes acceptance of the updated Terms.
